Terms of Service
The terms that govern your use of TaxCare's website, mobile app, and Income Tax Return filing and Tax Expert services.
Last updated 26-Oct-2026
About these Terms
1.1 These Terms are a contract between you and Overseas Apps Private Limited ("TaxCare", "we"), office at NX One Tower, Tech Zone IV, Greater Noida, Uttar Pradesh 201318, registered office at Sri Ganganagar, Rajasthan.
1.2 They apply to app.taxcare.in, the TaxCare mobile app, and any partner web address that runs TaxCare.
1.3 You accept them by ticking the agreement on the sign-in screen. Please also read the Privacy Policy, the Refund & Cancellation Policy, the Cookie & Storage Notice and the AI Assistant Disclaimer. They form part of these Terms.
Who can use TaxCare
2.1 You must be 18 or older and able to make a contract under Indian law.
2.2 You may file for yourself, and for family members whose PAN you add after passing the Income Tax portal's own Aadhaar OTP for that PAN. You confirm you are allowed to act for each person you add. For a minor, you act as the parent or guardian.
Your account
3.1 Your account is tied to one Indian mobile number. You sign in with a one-time password.
3.2 A device you sign in on can stay signed in for up to 365 days. You can see and sign out any device in Profile → Security. Keep your phone and devices secure. If someone else uses a device you left signed in, tell us at once and sign that device out.
3.3 One PAN, one owner. A PAN can belong to only one TaxCare account at a time. Proof of ownership is passing the Income Tax portal's Aadhaar OTP for that PAN. If another account proves it later, the PAN moves to that account. The previous holder is alerted. If the PAN moved was that holder's own PAN, the family PANs on that account are removed too, and can be added back.
3.4 If you arrived through a partner's app, the partner confirmed your mobile number. You still use the same account as anyone else with that number.
What TaxCare does
4.1 TaxCare helps individuals and HUFs with their Income Tax Return. It fetches your statements from the Income Tax portal, prepares the return, checks it, and works out your tax.
4.2 TaxCare also offers a tax calculator, a view of your tax statements, refund-status tracking, the Shri assistant, a link to pay tax to the Government, and Tax Expert services (section 7).
4.3 TaxCare is an ITR filing platform. It offers self-filing and Expert-assisted filing as TaxCare's own service to you. The software does not give tax or legal advice (section 13). Tax Experts on our panel give professional services, under section 7.
4.4 Some returns are too complex for self-filing on TaxCare (for example audit cases, companies, firms, and some foreign, crypto or property-sale income). For those we offer a Tax Expert.
Preparing and filing your return
5.1 TaxCare prepares your return and checks it.
5.2 Authority to file — only after your approval. At the last step you review the full return and approve it by a deliberate action. By approving, you confirm that you have reviewed every figure, that tax, interest, fees and penalties are yours, and that TaxCare's liability is limited as set out in section 15. Your approval is recorded with the time and your IP address. Only then do you authorise TaxCare to submit that exact return to the Income Tax Department on your behalf, as an e-Return Intermediary. If anything in the return changes after you approve, you must approve again.
5.3 This authority is for that one return only. It is not irrevocable: you may withdraw it at any time before we submit, by going back from the filing step or writing to us, and you may remove TaxCare as your intermediary on the Income Tax portal at any time. The return is filed only when the Income Tax Department accepts it and issues an acknowledgement. We show you the acknowledgement. If submission fails, we tell you and nothing is filed.
5.4 E-verification is your duty. You must e-verify within the time the Income Tax Department allows (currently 30 days from filing), using TaxCare's e-verify step or the portal. An unverified return is treated as not filed. TaxCare sends reminders, but the duty is yours.
5.5 Data from the Income Tax portal. We show you what the Income Tax portal holds (Form 26AS, Form 168, AIS, TIS). We do not change it. It can be wrong or incomplete. If it is, you must tell us what is correct, or raise it with the Department or the deductor.
5.6 Your duty to review. You must check every figure before approving. You are responsible for what is in your return, including income TaxCare could not see.
5.7 Tax, interest, fees and penalties are yours. Any tax, interest, late fee or penalty due under the law is your liability, not TaxCare's. That includes amounts arising from late filing, late verification, or incorrect information. See the box at the top of section 15.
5.8 Paying tax. When you pay tax through TaxCare, you are sent to the Income Tax Department's own payment page. The money goes to the Government, not to TaxCare. TaxCare adds no fee. TaxCare cannot refund tax paid to the Government; only the Department can.
Your Income Tax portal password
6.1 To fetch your documents, TaxCare helps you reset your portal password using the portal's Aadhaar OTP, and stores the new password encrypted. TaxCare is an Income Tax Department approved e-Return Intermediary (ERI) for Type 1, Type 2 and Type 3. Type 3 filing needs your e-filing portal password, so storing it is a required part of the service, not optional. If you do not want us to store it, we cannot provide the service.
6.2 You authorise TaxCare to use it only to sign in to the Income Tax portal for that PAN, to fetch your documents and status. We will not use it for anything else. We erase it when you ask us to, subject to any retention period that applies (Privacy Policy, sections 6 and 10).
6.3 You can revoke this at any time: remove the PAN in the app, or change the password on the portal. Removing a PAN stops all use at once and the stored password is erased (Privacy Policy, section 6).
Tax Expert services
7.1 Expert-assisted ITR filing is TaxCare's own service to you. TaxCare is the party you contract with, and the principal. It is not a marketplace. A Tax Expert is a professional on TaxCare's own verified panel. We check their professional registration before assigning work. We assign your order automatically. You always see who has it. You pay TaxCare the price, and TaxCare runs the panel.
7.2 Before you pay, you accept the engagement terms for the service (ITR filing, notice reply, or other assistance). They are shown in the order. They describe scope, turnaround and cancellation. Your acceptance is recorded with the time and IP address. Where these Terms and the engagement terms differ, the engagement terms apply to that order.
7.3 TaxCare is responsible to you for the Expert-assisted service, within the limits in section 15.
7.4 You pay the full price when you book. If the work turns out to need more than the service covers, the Tax Expert may quote an additional fee. You may accept or decline it. Nothing extra is charged unless you accept and pay it.
7.5 Nothing is filed or submitted for you until you approve it in the order.
7.6 Turnaround targets are in the engagement terms. They are targets measured in business hours and days, and depend on you sending what is asked for. A statutory due date (for example a notice deadline) cannot be extended by us.
7.7 Cancellation and refunds are in the Refund & Cancellation Policy, section 4.
7.8 One return, one filing. For a given PAN and tax year there can be only one open ITR order. Once you have paid for a Tax Expert to file a return, you cannot self-file that same return on TaxCare. Once the Tax Expert has filed it, only a revised or updated return can be filed here.
7.9 If you have a concern about an order, use "Raise a concern" on the order page.
Assisted service
8.1 You may invite TaxCare staff, or a partner organisation, to help in your account. They can prepare your return for your approval. They cannot change your mobile, email or consents, or delete your account.
8.2 Every action they take is shown to you under Profile → Activity by others. You can end the access at any time.
Prices, payment and invoices
9.1 Prices are shown before you pay, on the Pricing page and at checkout. Every price is a final price. There are no hidden charges.
9.2 Self-filing fees follow the current price book shown on the Pricing page. We may change prices for the future. A change never affects a payment already made.
9.3 Payments are taken by our payment partner, Cashfree Payments. TaxCare never sees or stores your card or bank details.
9.4 Every payment gets a numbered invoice, which you can download from Payments.
Offers, coupons and referrals
10.1 Offers and their terms are shown where the offer appears — on the Pricing page, the offer page, the Referrals card, or at checkout. Those terms apply. We do not repeat percentages here because they can change; the figure shown to you when you redeem is the one that applies to you.
10.2 One discount per payment. If both a coupon and a referral reward could apply, you get the better one.
10.3 Referral rewards. A friend who signs up with your link gets their discount when they redeem it. You get yours only after that friend's first payment succeeds. A reward is a discount on a future TaxCare service. It is not cash or credit, cannot be transferred, and is not refunded.
10.4 Share your link yourself. Do not send it to people who have not asked for it, and never give us someone else's number. We may cancel rewards obtained by fake accounts or abuse.
Shri, the AI assistant
11.1 Shri gives general guidance only. It can be wrong. It is not tax, legal or financial advice, and it does not see your returns or tax data. Check anything important on your return screen or with a Tax Expert.
11.2 Do not type your PAN, Aadhaar, phone or email. If you do, we mask them before sending. A fair-use limit applies. See the AI Assistant Disclaimer.
Acceptable use
You must not:
- Use someone else's PAN, mobile number or portal credentials without authority.
- Upload false documents or enter information you know is false.
- Try to get into another person's account or data, or test our security without written permission.
- Overload, scrape, copy or reverse-engineer TaxCare.
- Upload malware or unlawful content, or harass our staff or Tax Experts.
- Abuse offers or referral rewards.
No tax or legal advice
13.1 TaxCare's software, calculator, statements and Shri are tools. They are not professional advice. TaxCare does not know your full circumstances. You decide what to file. If you need advice, order a Tax Expert service or consult a professional of your choice.
Service availability and third parties
14.1 TaxCare depends on systems we do not control: the Income Tax portal and ERI systems, TaxBridge, payment, SMS, WhatsApp and email providers, and your bank. When they are slow, down or change, parts of TaxCare may not work.
14.2 We are not responsible for delays or failures caused by those systems. We will tell you when we know of one that affects you. File well before the due date. A portal outage near a due date does not move the date unless the Government extends it.
14.3 We may pause TaxCare for maintenance. We will try to give notice and avoid the days before a due date.
Our responsibility to you (limitation of liability)
15.1 We will provide TaxCare with reasonable skill and care.
15.2 If you think a figure in your return is wrong, tell us as soon as you can. We will look at it and, where it is our error, help you prepare a revised return. This is a courtesy and does not make us liable for tax, interest, fees, penalties or notices.
15.3 We are not liable for loss caused by: information you gave or approved that was wrong; data from the Income Tax portal; your not reviewing, filing or verifying in time; or the events in section 14 and section 17.
15.4 We are not liable for indirect or consequential loss, or loss of profit or opportunity.
15.5 Cap. Our total liability to you for all claims is limited to the fees you paid TaxCare for that service in the 12 months before the claim arose.
15.6 Nothing in these Terms limits liability that the law does not allow to be limited, including liability for fraud, wilful misconduct, death or personal injury, our duties and penalties under the DPDP Act, and your statutory rights as a consumer under the Consumer Protection Act, 2019.
Indemnity
16.1 If you break these Terms or the law — for example by using a PAN without authority or giving false information — and that causes TaxCare a loss or a claim, you will make good that loss. This does not apply to losses caused by TaxCare.
Events beyond our control
17.1 We are not responsible for failure or delay caused by events we cannot reasonably control — for example natural disasters, epidemics, war, government action, power or network failures, Income Tax portal outages, or failures of our providers we could not reasonably prevent. We will tell you and resume as soon as we can. This does not remove your right to a refund under the Refund Policy for a service we cannot deliver.
Electronic records and communications
18.1 These Terms, your consents, your approvals and our invoices are electronic records under the Information Technology Act, 2000. Ticking a box or tapping to approve is your agreement. We may send notices to you in the app, by email, SMS or WhatsApp.
18.2 Intermediary position. TaxCare provides its own service to you; it is not mainly a platform for other people's content. Where TaxCare does host content you upload or messages you send (for example documents, tickets, chats), it follows the Information Technology (Intermediary Guidelines and Digital Media Ethics Code) Rules, 2021 to the extent they apply, including the grievance process. TaxCare operates as an approved ERI and as a consumer-facing online platform, and applies the strictest grievance timeline of those regimes (Grievance Redressal page).
Intellectual property
19.1 TaxCare's software, design and content belong to us or our licensors. You may use them only to use TaxCare.
19.2 Your data and documents stay yours. You give us permission to use them only to provide TaxCare to you, as described in the Privacy Policy.
Suspension and termination
20.1 You may close your account at any time from Profile → Danger Zone → Delete account. What happens to your data is in the Privacy Policy, section 10.
20.2 We may suspend or close an account if we reasonably believe it is used for fraud, against these Terms or the law, or to protect other users. Unless the law or a security risk prevents it, we will tell you why and let you respond first. You keep the right to download your filed returns and invoices, and to the refunds the Refund Policy gives.
20.3 Sections 5.5–5.8, 13, 15, 16, 18, 21 and 22 continue after the account ends.
Changes to these Terms
21.1 If we change these Terms in a way that matters to you, we will tell you in the app and by email at least 15 days before the change applies. If you do not agree, you may close your account before then. A change never applies to a payment or order already made.
Disputes and governing law
22.1 These Terms are governed by the laws of India.
22.2 Talk to us first. Contact support, then the Grievance Officer (see the Grievance Redressal page). Most problems are fixed there.
22.3 If the grievance route does not resolve it, the courts at Sri Ganganagar, Rajasthan, where Overseas Apps Private Limited has its registered office, have jurisdiction. Nothing here stops you from going to a Consumer Commission, including where you live, as the Consumer Protection Act, 2019 allows, or to the Data Protection Board of India.
General
23.1 If a part of these Terms is invalid, the rest still applies. If we do not enforce a right at once, we do not give it up. You may not transfer your account. We may transfer these Terms to a buyer of our business, who must honour them.
23.2 These Terms are in English. A Hindi translation is provided for convenience.
