How to file ITR with multiple Form 16s

If you changed jobs or had two employers in the same year, you get a Form 16 from each. Add the salaries, claim the standard deduction once, take TDS from every Form 16, and check that your tax is not under-paid.

On this page

With two or more Form 16s, you file one return for the tax year. Add the salary from all employers, claim the standard deduction once, claim the TDS shown on every Form 16, and then check the total tax. Because each employer may have given you the full slab benefit, the combined tax can be higher than the TDS deducted, and you may need to pay the difference.

The figures here are the ones TaxCare applies for the tax year 2025-26. The tax year 2026-27 figures are provisional.

What a Form 16 is

Form 16 is the TDS certificate that an employer gives for salary. It shows the salary paid, the exemptions and deductions the employer allowed, and the tax deducted and deposited. Under the Income-tax Act, 2025 the same certificate is Form 130.

Step by step

1. Gather every Form 16 and your statements

Collect Form 16 from each employer for the tax year. Also download your AIS and your Form 26AS (up to the tax year 2025-26) or Form 168 (from 2026-27). The statements show the salary and TDS each employer reported, which helps you spot a missing or wrong Form 16.

2. Add the salaries

Total the gross salary from each Form 16, including allowances and perquisites as the employers report them. If you got a notice pay, leave encashment or gratuity when you left, check how each is treated.

Some of these have exemption limits. For the tax year 2025-26, gratuity is exempt up to ₹20,00,000 for a non-Government employee, and leave encashment on retirement up to ₹25,00,000 for a non-Government employee; for Government employees both are exempt in full. For the tax year 2026-27 TaxCare carries these limits forward provisionally.

3. Claim the standard deduction once

The standard deduction is one deduction for the year, not one per employer: ₹50,000 under the old regime and ₹75,000 under the new regime. Each employer may have given you the full amount in their Form 16, so the total of their figures can exceed what you may claim. Your return should show it once.

4. Claim deductions once, in the right regime

Under the old regime you can claim deductions such as 80C, 80D and home loan interest. Do not claim the same deduction twice because both employers showed it. Under the new regime almost none are allowed.

5. Add the TDS

Take the TDS from each Form 16 and add it. Then compare it with the credit shown in Form 26AS or Form 168. Only the credit that appears there can be claimed. If the numbers differ, see Form 16 does not match AIS.

6. Work out the tax and compare with TDS

Calculate tax on the combined income under both regimes and compare it with the total TDS. If TDS is lower, you pay the difference (self-assessment tax) before you file. If the tax left after TDS is ₹10,000 or more, advance tax was due during the year, so interest for not paying it (sections 234B and 234C) can apply even though the shortfall came from two employers. Interest under section 234A is added if you file after the due date.

Why a shortfall happens

Each employer calculates your tax assuming you earn only from them. So each gives you the full benefit of the lower slabs. When you add the two incomes, the second salary is taxed at a higher slab than the employer assumed.

Example (illustration only): two employers each pay ₹6,00,000 in the year. Each assumes ₹6,00,000 of salary, and with the new regime rebate each may deduct little or no TDS. But the combined salary is ₹12,00,000, from which the standard deduction brings taxable income to ₹11,25,000. In the new regime on the 2025-26 rules the rebate covers taxable income up to ₹12,00,000, so tax is nil in this particular case. If the salaries were ₹8,00,000 each, each employer sees taxable income of ₹7,25,000 and deducts nothing because of the rebate. The combined taxable income is ₹15,25,000, and slab tax of ₹1,08,750 plus 4% cess comes to ₹1,13,100, far more than the employers deducted.

Special points

  • Joining mid-year: you can give your new employer the salary and TDS from your previous employer in Form 12B (rule 26A; under the Income-tax Rules, 2026 this is Form 122), so that it computes tax on the whole year. Many people skip this and face a shortfall later.
  • Different regimes in two Form 16s: each employer may have used a different regime. The regime in your return is your own choice, regardless of what the employers used.
  • HRA: the HRA exemption is available only in the old regime, and it is worked out from the HRA received, the rent you actually paid and your salary, so claim it only on the rent you paid.
  • Employer NPS contribution: if both employers paid into NPS, add the two contributions. The deduction is limited to 14% of your salary in the new regime (10% in the old regime for an employer other than the Central or State Government).

What to do if one Form 16 is missing

Use your AIS and Form 26AS or Form 168. They show the salary and TDS that the employer reported. You can file from these statements, and ask the employer for the certificate. If the employer never reported your TDS, the credit will not appear and you cannot claim it.

How TaxCare helps

TaxCare brings in your salary and TDS from the portal for each employer, adds them together, and applies the standard deduction once. It compares the result with your AIS and Form 26AS or Form 168, shows both regimes, and tells you if there is a tax shortfall to pay before you file. Nothing is submitted until you approve. See pricing, or ask a Tax Expert if a certificate is missing.

Questions on this topic

Do I file one ITR or two if I have two Form 16s?

One. All your income for the tax year goes into one return, with the salary and TDS from every employer.

Can I claim the standard deduction twice?

No. It is a single deduction for the year: ₹50,000 under the old regime and ₹75,000 under the new regime on the 2025-26 rules.

Why might I owe tax even though both employers deducted TDS?

Each employer may have taxed your salary as if it were your only income, so the slab benefit was used twice. When the salaries are added together, the total tax can be higher than the TDS.

What if one employer did not give me a Form 16?

Use your AIS and Form 26AS or Form 168 to see the salary and TDS reported, and ask the employer for the certificate. You can still file from the statements.
